Mr. Anand Pathak
Partner, P&A Law Offices

Anand Pathak practices in the areas of US, European and Indian mergers, acquisitions and joint ventures, and technology licensing, distribution and agency arrangements. He has extensive experience in advising clients on the full range of US, European and Indian legal issues in connection with international mergers and acquisitions, privatizations, technology licensing, distribution, franchising and agency arrangements, and European and Indian laws on competition, state assistance, trade and intellectual property. He also has represented clients claiming compensation from the United Nations Compensation Commission for losses suffered as a result of the Iraqi invasion and occupation of Kuwait.

Prior to joining P&A Law Offices in New Delhi, Anand was a lawyer in the Brussels, Cleveland and Palo Alto offices of Jones Day.

Anand attended all of the EU Council negotiation meetings leading to the adoption of the EU Merger Control Regulation and assisted in the drafting of the implementing regulations and guidelines issued by the EU Commission.

Anand has represented Indian and multinational companies in a number of cross-border acquisitions and joint ventures in the US, Europe and Asia, cross-border ADR/GDR and stock swap transactions, tender offers under the Indian Takeover Code, financings and commercial contracts, including cross-border BPO/outsourcing transactions.

Anand was presented with the National Law Day Award – 2005 by the Prime Minister of India for his unique contribution in the field of corporate law and for bringing foreign investments into India. He was awarded “Best M&A Lawyer in India in 2008” and “India M&A Legal Counsel of the Year” in 2009. He is also listed in The International Who’s Who of Competition Lawyers (2009 and 2010).

Anand is a member of the board of editors of the EC Merger Control Reporter, is a frequent speaker on EU and Indian competition laws in seminars, and is the author of several articles on EU and Indian competition laws, including “Articles 85 and 86 and Anticompetitive Exclusion in EEC Competition Law,” 2 Legal Issues of European Integration (1988); “EEC Concentration Control: The Foreseeable Uncertainties,” International Company and Commercial Law Review 72 (1990); “The EC Commission’s Approach to Joint Ventures: A Policy of Contradictions,” European Competition Law Review 171 (1991); “EC Merger Regulation Enforcement During 1992,” European Law Review CC 132 (1993); “Market Definitions, “Compatibility with the Common Market and Appeals from Commission Decisions under the Merger Regulation During 1993,” European Law Review CC 166 (1994); and “India’s New Competition Act: A Muddled Beginning,” 2008 Guide to Competition and Antitrust, IFLR page 44. His comments on various European and Indian legal matters have regularly featured in a number of legal periodicals and journals, including the International Herald Tribune, the Wall Street Journal, Corporate Control Alert, Business World, Business Today, Economic Times, Financier Worldwide and India Business Law Journal.

Anand is a Fellow of the Cambridge Commonwealth Society and a member of the Bar Council of Delhi, the Honorable Society of Gray’s Inn, London; the IBA and the ABA. Anand is the Chairman of the Task Force on Competition Law of the Federation of Indian Chambers of Commerce and Industry (FICCI). He is also the advisor to the Competition Commission of India on competition law.
